The purpose of this chapter is to provide a program to prevent the spread of graffiti, establish a process for the removal of graffiti from both real and personal, public and private property, and to assess and recover costs related to such removal. The city council finds and determines that graffiti is obnoxious and a public nuisance which must be abated in order to prevent blight, the deterioration of property and business values, and the spread of criminal gang activity. Government Code Section 53069.3 authorizes the city to enact an ordinance to provide for the use of city funds to remove graffiti or other inscribed material from public or privately owned real or personal property located within the city and to replace or repair public or privately owned property within the city that has been defaced with graffiti or other inscribed material that cannot be removed cost effectively.
