(1) Sections 11.02.340. Notwithstanding the provision of CMC 8.04.010, Section 11.02.340 of the health code is amended to read as follows:

a. Section 11.02.340. Temporary refreshment stand. “Temporary refreshment stand” means any food preparation or dispensing operation conducted in connection with a fair, circus, or public exhibition or gathering, or offering food for sale or gift to the general public for a temporary period of time in one (1) location.

A temporary refreshment stand shall not operate for more than thirty (30) days. A temporary refreshment stand shall only operate in locations approved by the Director. The Director shall make an investigation of the premises, equipment, and facilities to be used in the operation of the refreshment stand and shall, when he or she deems it necessary for the protection of the public health, restrict the operation to the preparation and servicing of those foods which in his or her opinion would not be injurious to the public health when prepared and served with such facilities as the operator intends to use.
